DECISION OF THE BOARD; March 29, 2000
1This is an application for certification.
2The applicant advised the Board by letter dated March 3, 2000 that it wishes to withdraw the application. The representation vote scheduled for March 7, 2000 was cancelled.
3By letter dated March 6, 2000, the responding party submits that the Board should impose a bar against a further application for certification for the same proposed bargaining unit for a period of one year. It notes that the applicant applied for certification with respect to the same bargaining unit approximately eight months ago and also withdrew that application before a vote was held. It submits that the applicant is “abusing the Board process by making repeated applications without any material change in the circumstances (i.e., the proposed bargaining unit and the number of employees).”
4By letter dated March 27, 2000, the responding party repeats its request for a bar and asserts that the applicant is continuing an organizing drive in the same work place.
5The applicant is hereby directed to file its response to the responding party’s request for a bar by no later than April 12, 2000. After receiving the response, if any, within the time permitted, the Board will consider the matter further.
