DECISION OF THE BOARD; June 14, 2000
1In response to the Board’s decision of April 3, 2000 the Ministry of Labour by letter dated June 7, 2000 advised the Board as follows:
“Please be advised that we have received a certified cheque in the amount of $4,746.91 from the above-noted employer related to their Application for Review.
Arimtec International Inc. (“Arimtec”) has paid $2,099.10 directly to Mr. A. Verdoni. I understand they are no longer pursuing a review of this portion of the above-noted Order. Arimtec has paid the remaining balance of the Order less statutory deductions. As of May 19, 2000, $4,746.91 is being held in trust. I understand this to be full payment of the portion of the Order that Arimtec wishes to review.”
2The application for review was filed without the required payment of the Order to Pay pursuant to the Employment Standards Act (the “Act”). The statute requires payment of the Order to Pay before the Board can proceed with the application.
3Having regard to the confirmation received from the Ministry that there has been full payment of the portion of the Order that the employer wishes to review, the time for applying for this review is hereby extended to June 7, 2000.
