This is a referral of a grievance in the construction industry brought pursuant to section 133 of the Labour Relations Act, 1995 (the “Act”). It was filed on February 21, 2000 and the Certificate of Delivery states that the necessary materials were served on the responding party by providing them to Purolator Courier on February 18, 2000 and receiving assurances that the material would be delivered no later than February 21, 2000 at 2:00 p.m.
No Request for Hearing and Notice of Intent to Defend has been filed by the responding party. The applicant has requested that the Board issue a default judgement in that circumstance. We have reviewed the file. On the basis of the material filed, we are not prepared to make the orders requested by the applicant.
This matter will therefore proceed to hearing as scheduled on March 16, 2000.
