1This is an application under section 99 of the Labour Relations Act, 1995, S.O. 1995, ch. 1 (the “Act”). Prior to the commencement of the hearing, the union parties entered into an agreement which provides as follows:

The parties appearing before the Ontario Labour Relations Board on April 14, 2000 have agreed to settle their outstanding jurisdictional dispute arising on the Brampton Court House Project of Ellis Don Ltd. and Basic Structure Engineering as follows
- Sheet Metal Workers International Association Local 30 agrees that,
all work in connection with the offloading, rigging, handling of materials and the assembly and installation of field assembled architectural metal panel curtain wall systems consisting of an inner metal skin, fastening of right angle clips, stabilizer bars/angle iron/galvanized metal angle, insulation bats, outer metal skin and caulking/weather stripping
is within the work jurisdiction of the International Brotherhood of Painters and Allied Trades Local 1819 Glaziers and Metal Mechanics.
- International Brotherhood of Painters and Allied Trades Local 1819 Glaziers and Metal Mechanics agrees that,
all work in connection with the installation of sheet metal siding that does not form part of architectural metal panel curtain wall system
is within the work jurisdiction of the Sheet Metal Workers International Association Local 30.
