DECISION OF THE BOARD
The applicant has filed an application under section 96 of the Labour Relations Act, 1995 (the “Act”) alleging a violation of section 74. However, the responding party and intervenor have advised the Board that they were not served with a copy of the application as required by the Board’s Rules. Furthermore, the application contains no particulars of any violation of the Act that the responding party is alleged to have committed. The Board’s rules require that such complaints contain a “detailed statement of all material facts relied upon, including the circumstances, what happened, when and where it happened, and the names of any persons said to have acted improperly.”
As this application has not complied with the Board’s Rules in a number of significant respects as outlined above it is hereby dismissed. However, the dismissal of this application is without prejudice to the applicant’s ability to file a new application with the Board which complies with the Rules.
