DECISION OF THE BOARD; July 6, 2000
1. This matter is an appeal of an inspector’s order dated June 2, 2000 pursuant to section 61 of the Occupational Health and Safety Act (the “Act”) which was filed on July 5, 2000.
2. Section 61(1) of the Act provides as follows:
- (1) Any employer, constructor, licensee, owner, worker or trade union which considers himself, herself or itself aggrieved by any order made by an inspector under this Act or the regulations may appeal to the Board within 30 days after the making of the order.
There is no provision in the Act that gives the Board the discretion to extend the time limits for the filing of an appeal.
3. This matter was filed 33 days after the date of the order and accordingly was not filed in a timely manner. As a result, this matter is hereby dismissed.
