DECISION OF THE BOARD; August 15, 2000
- The applicant has filed an application for review of an officer’s decision pursuant to the Employment Standards Act. But a review of the application indicates that Mr. David is not seeking a review. He indicates that on February 28, 2000, he wrote to the Officer seeking to withdraw his complaint because he was pursuing his claim in the courts. I note that section 63.3(4) provides as follows:
64.3 (4) An employee is entitled to commence a civil action respecting a matter described in subsection (1) or (2) if the employee withdraws his or her complaint under the Act within two weeks after it is filed.
- The applicant withdrew his claim more than 2 weeks after it was made. However, that is not a concern of the Board. Mr. David has clearly indicated he does not want to pursue this claim.
DISPOSITION
- This matter is terminated.
