DECISION OF THE BOARD; March 13, 2000
- This is an application under section 133 of the Labour Relations Act, 1995. The matter was scheduled to come on for hearing before the Board on March 13, 2000; however, on the day of hearing the parties were able to settle the matters in dispute between them. That settlement was reduced to writing and reads as follows:

The parties request that the Board amend the style of cause to "Viking Drywall Acoustics Inc.".
The parties request that the Board make the following orders and declarations in a Board order,
(1) a declaration that Viking Drywall & Acoustics Inc. is bound to the Carpenters Provincial Collective [sic] between the Carpenters Employer Bargaining Agency and the Carpenters District Council of Ontario, United Brotherhood of Carpenters and Joiners of America effective May 1, 1998 to April 30, 2001 ("the Carpenters Provincial Collective Agreement");
(2) a declaration that Viking Drywall & Acoustics Inc. has violated the Carpenters Provincial Collective Agreement by failing to remit dues, contributions & deductions contrary to article 9 & 10;
(3) Viking Drywall & Acoustic Inc. owes damages for violating the Carpenters Provincial Collective Agreement;
(4) an order that Frank Bussari attend at the Labour Relations Board, 505 University on Monday March 16, 2000 at 9:30 a.m. and provide the following documents to the applicant.
(1) remittance forms for October, November, December 1999 and January 2000;
(2) three post dated cheques dated for March 17 and March 29, 2000 for the unpaid dues, contributions and deductions for the months of Oct., Nov., Dec., 1999 & Jan. 2000 and a cheque for costs of $514.00 dated March 30, 2000;
(3) one cheque dated March 16, 2000 for $268.10 payable to Roberto Ventura.
(5) a declaration that the Board has remained seized on the quantum of damages owing.

Having regard to the settlement, the Board hereby makes the consent orders, declarations and directions to which the parties have agreed.
If the parties are unable to agree on the amounts owing at the Labour Relations Officer’s meeting on March 16, 2000, the Board (it may be a different panel of the Board) will remain seized.
