Decision
1This matter is an application for review of Order to Pay Number 46666 dated December 3, 1997. The Order to Pay was in the amount of $9,281.74 inclusive of $1,612.64 in statutory administrative costs.
2Under cover of letter dated August 19, 1998, counsel for the applicant wrote to the Board and indicated that the matter had been settled on the basis that the applicant would pay settlement funds in the amount of $7,500. less deductions directly to Mr. Poupa. A letter from Mr. Poupa confirming such settlement was enclosed. In addition, the applicant withdrew its application for review and requested that the $9,281.74 paid into trust be returned to it. A Direction from Mr. Poupa authorizing and directing the release of the funds to the applicant was also enclosed. A copy of counsel’s August 19, 1998 letter and enclosures are attached to this decision.
3Having regard to the foregoing, the Director is hereby directed to pay the $9,281.74 presently held in trust to the applicant. The Ministry of Labour, a responding party to the application but not a party to the settlement reached shall have 15 working days from the date of this decision to request, if necessary, that this matter be listed for hearing.
4In the absence of a request described in the foregoing paragraph, this matter shall be deemed to be terminated.
