Decision
1This is a displacement application for certification which was filed with the Board on March 31, 2000. The applicant has not yet established that it has trade union status.
2In its response to the application the responding party states that it has contracted out the services being supplied by the employees in the proposed bargaining unit and that they will no longer employ those individuals effective April 7, 2000. The responding party also indicates that the employees will be offered employment with the contractor. If they accept that employment they would be in a bargaining unit represented by a different trade union. Under the circumstances the Board considers it appropriate to direct the applicant to file submissions with the Board prior to ordering a representation vote. The submissions should respond to the issues raised by the responding party and be filed with the Board and provided to the responding party on or before 5:00 p.m. Friday April 7, 2000. The Board will decide after reviewing the submissions whether to hold a representation vote.
