DECISION OF THE BOARD; June 30, 2000
This is an application pursuant to section 96 of the Labour Relations Act, 1995 (the “Act”) alleging that the responding parties have violated sections 72 and 87 of the Act.
The responding parties filed their response with the Board on June 9, 2000. In their response, the responding parties brought to the Board’s attention an order of the Ontario Superior Court of Justice staying all proceedings against a number of entities including the responding parties pursuant to the Companies’ Creditors Arrangement Act, R.S.C. 1985, c. C-36, as amended.
The responding parties request that this application be dismissed as it is a proceeding which falls within the scope of the aforementioned court order.
The Board notes that the response was copied to the applicant in these proceedings. The Board directs the applicant to file with the Board by no later than July 10, 2000 any representations it wishes to make with respect to the responding parties’ request.
