DECISION OF THE BOARD; July 13, 2000
This is an application under section 96 of the Labour Relations Act, 1995 (the “Act”) alleging that responding parties have violated sections 72 and 87 of the Act.
Further to the Board’s decision dated June 30, 2000, the parties have filed submissions with respect to the responding parties’ request that this matter be dismissed in accordance with the order of the Ontario Superior Court of Justice staying all proceedings against the responding parties pursuant to the Companies’ Creditors Arrangement Act, R.S.C. 1985, c. C-36, as amended.
Having reviewed the submissions filed by the parties, the Board is satisfied that the proceedings in Board File No. 0656-00-U are stayed until December 31, 2000 pursuant to the order of the Ontario Superior Court of Justice. Accordingly, the Board directs that this matter be adjourned sine die for a period not exceeding one year. Following December 31, 2000, any party may request that the Board deal with this matter. In the event that no party makes such a request within the one-year period, then this matter will be deemed terminated without further notice to the parties.
