Pursuant to the agreement reached between the parties, the applicant agrees that this application be dismissed pursuant to paragraph 7 of subsection 8.1(5) of the Labour Relations Act, 1995 (the “Act”). The parties agree that pursuant to section 10(4) of the Act no statutory bar is imposed on any future certification applications that may be made by the applicant, on terms agreed by the parties.
