DECISION OF THE BOARD; January 13, 2000
1The style of cause is hereby amended to reflect the correct name of the responding party: "Ontario Public Service Employees’ Union".
2This is an application for termination of bargaining rights. The responding party objected to the application on the basis that it was untimely pursuant to section 67(3) of the Labour Relations Act, 1995. The Board (differently constituted) decided to hold a vote and seal the ballot box. The vote was held on December 17, 1999.
3At the hearing of this matter the Board heard and considered the parties submissions on the timeliness of the application. The Board orally dismissed the application on the basis that it was untimely pursuant to section 67(3) of the Act. The Board directed that the ballots be destroyed without counting them. The Board advised the parties that written reasons for this decision will subsequently be provided.
4The intervenor is directed to post copies of this decision in places where it is most likely to come to the attention of the affected employees. Copies of the decision should remain posted for 30 days.
