DECISION OF THE BOARD; March 2, 2000
1. This is a referral of a grievance to arbitration pursuant to section 133 of the Labour Relations Act, 1995 (the “Act”).
2. Upon hearing the submissions from counsel for the applicant and upon the agreement of the parties, the Board hereby makes the following declarations:
declares that Trafalgar Mechanical Inc. is bound to the collective agreement between the Mechanical Contractors Association of Ontario and the Ontario Pipe Trades Council effective May 1, 1998 to April 30, 2001 (the “collective agreement”);
declares that Trafalgar Mechanical Inc. violated the terms and conditions of the collective agreement;
orders Trafalgar Mechanical Inc. to pay to the applicant the sum of $7,000.00 in accordance with the following schedule:
(a) $3,500.00 payable on or before March 10, 2000;
(b) $3,500.00 payable on or before April 17, 2000.
