DECISION OF THE BOARD; August 24, 2000
1. This is an application under section 69 of the Labour Relations Act, 1995 (the “Act”).
2. By decision dated July 24, 2000 the Board directed that a representation vote be taken among employees in the following voting constituency:
all office and clerical staff employed by Bracebridge Hydro‑Electric Commission, save and except managers and those above the rank of manager.
3. On the taking of the representation vote directed by the Board, none of the employees who cast ballots cast their ballots in favour of the applicant.
4. The employer has requested that the Board terminate the applicant’s bargaining rights. The applicant has advised the Board that it does not oppose the position advanced by the employer.
5. Accordingly, the Board declares that Bracebridge Hydro-Electric Commission is not bound by the collective agreement between the applicant and Ontario Hydro Services Company Inc. and that any bargaining rights held by the applicant with respect to the employees described in paragraph 2 of this decision are hereby terminated.
