DECISION OF THE BOARD; July 24, 2000
This is an application pursuant to section 96 of the Labour Relations Act, 1995 (the "Act") alleging that the responding party violated section 74 of the Act.
In a letter to the Board dated July 6, 2000, the applicant states that he has not served the responding party and employer with a complete copy of his application. He states that prior to doing so, he requires a copy of his “file” held by the responding party, particularly in respect of matters considered by the responding party’s Executive Council.
The applicant may not withhold parts of his application from the other parties. The Board will not proceed further with this application until the responding party and the employer have been properly served by the applicant with a complete copy of the application and supporting materials and the applicant has confirmed same with the Board in accordance with the Board’s Rules of Procedure. The applicant has until Friday, August 4, 2000 to do so, failing which the application will be deemed terminated.
The Board declines to order the responding party to produce its internal documents in respect of the applicant.
