DECISION OF THE BOARD; July 18, 2000
- This is an application for the referral of a grievance to arbitration pursuant to section 133 of the Labour Relations Act, 1995, S.O. 1995, ch. 1, as amended (the “Act”). Prior to the hearing set in this matter, the parties entered into an agreement to settle this matter. This agreement provides as follows:
MINUTES OF SETTLEMENT
BETWEEN:

The “Responding Party”

WHEREAS the Applicant has referred the above noted grievance on behalf of the Applicant and its members to arbitration pursuant to the Labour Relations Act;
AND WHEREAS the parties wish to make arrangements to further harmonious labour relations;
NOW THEREFORE the parties agree as follows and jointly request that the Board make the following declarations and orders:
A Declaration that the Applicant and the Responding Party are bound by the collective agreement between them effective from April 1, 1998 to April 30, 2000 and the renewal thereof, which incorporates the terms and conditions of the collective agreement between the Applicant and the Toronto and District Carpentry Contractors Association (“the Agreement”).
A Declaration that the Responding Party has violated Articles 10, 11, 12, and Specialty Appendix “A” of the Agreement.
An order that the Responding Party pay to the Applicant forthwith as damages arising from the above-noted violations: the sum of $28,259.10 in respect of unpaid remittances and employer contributions for the January to May 2000 work months.
It is agreed that the foregoing amount does not include any adjustments, if adjustments are necessary, arising from the ongoing review of the Responding Party’s payroll records for possible discrepancies.
