Service Employees International Union, Local 220 v. Victorian Order of Nurses – Middlesex Elgin Branch
3336-99-R Service Employees International Union, Local 220, Applicant v. Victorian Order of Nurses – Middlesex Elgin Branch, Responding Party.
BEFORE: Anthony Brown, Vice-Chair, and Board Members J. A. Rundle and D. A. Patterson.
DECISION OF THE BOARD; February 17, 2000
1This is an application for certification.
2The applicant is Service Employees International Union, Local 220.
3The membership evidence submitted by the applicant does not show that the applications for membership are in respect of Local 220 of Service Employees International Union. Rather, the applications are for membership in the international union. Evidence of membership in an international union is not generally accepted as evidence of membership in a local thereof. See Chapleau Forest Products Limited, [1990] OLRB Rep. Dec. 1243 at 1246.
4Accordingly, the Board finds that the applicant has not complied with subsection 7(13) of the Labour Relations Act, 1995 (“the Act”).
5The application is dismissed.
