DECISION OF THE BOARD; July 4, 2000
This is an application pursuant to section 96 of the Labour Relations Act, 1995 (the "Act") alleging violation of section 74.
The responding party filed a response in which it indicates that the applicant has settled his outstanding grievances against A & P Ltd., with the assistance of the responding party. It further states that a claim for overtime pay has also been resolved.
The applicant is directed to file a reply to the submissions of the responding party. The applicant shall respond to each of allegations of the responding party and shall state why his application should proceed any further if the union has in fact helped him settle his grievances.
The applicant shall file his reply by no later than July 19, 2000, after which the Board will consider the matter further. The parties should be aware that the Board may dispose of the application on the basis of written submissions, without a hearing or consultation.
If no reply is received from the applicant as directed, then the matter will be deemed terminated.
