DECISION OF THE BOARD; October 27, 2000
1This is a referral of a grievance under section 133 of the Labour Relations Act, 1995 (the “Act”). Further to the agreement of the parties, this matter was adjourned sine die on November 9, 1999. The parties subsequently entered into Minutes of Settlement which further resolves the matters in dispute. The Board notes that the grievor was one of the parties executing the Minutes of Settlement.
2The Board has received the request from the grievor to proceed with this application. The grievor is not a party of the applicable collective agreement which is binding upon the applicant trade union and the respondent employer. In addition, the grievor is not a party to the grievance referral. Accordingly, the grievor has no standing to request that this matter proceed. Further, the matters in dispute appear to have been fully solved by virtue of the Minutes of Settlement which, as noted previously, was executed by the grievor as well as the employer and the trade union.
3This matter is hereby withdrawn.
