DECISION OF THE BOARD; August 29, 2000
1This is an application under section 96 of the Labour Relations Act, 1995, S.O. 1995, c.1, as amended ('the Act') in which the applicant claims that the responding trade union ('the union') has violated section 74 of the Act.
2By letter dated August 23, 2000 counsel for the union advised that it has not received a copy of the application. The confirmation of delivery has been certified by the applicant as having been made to the union.
3The responding union requests that the application not be processed and the labour relations officer’s meeting be cancelled pending receipt by the union of the application. That meeting is scheduled for September 22, 2000.
4The applicant is directed to deliver its application in the way contemplated by the Board’s Rules of Procedure within 5 days from the date of this decision. The responding parties will then have the usual ten(10) day period in which to file their responses. In this way, the labour relations officer’s meeting would still be able to be held on September 22, 2000.
5I remain seized to deal with this issue.
