DECISION OF THE BOARD; February 4, 2000
By correspondence dated February 3, 2000, counsel for the applicant seeks to amend its application by filing, in support of its application, a letter dated January 12, 2000 alleged to have been prepared by the responding party. Counsel for the applicant also seeks to amend the application by alleging a violation of section 70 of the Labour Relations Act, 1995, (the “Act”) in addition to the previous allegation of a violation of section 73 of the Act. Finally, counsel requests the Board to direct the responding party to provide the applicant particulars concerning paragraph 9 of Schedule “A” of the responding party’s response.
The Board makes the following orders and directions:
(i) the application is hereby amended to include an allegation of a breach of section 70 of the Act;
(ii) the application is further amended by adding the above-noted letter of January 12, 2000 as material in support of the application; and
(iii) the responding party is directed to provide the applicant, on or before February 18, 2000 particulars concerning the allegations made in
paragraph 9 of Schedule “A” of the response, including the circumstances, what happened, when and where it happened and the names of any persons said to have acted improperly.
