1This is an application pursuant to the Employment Standards Act for review of an Order to Pay (No. 52590) issued by an Employment Standards Officer.
2The matter was scheduled to be heard by the Board on July 5, 2000 at 9:30 a.m. and the parties were duly notified of this date by the Registrar.
3The applicant and the responding party failed to appear on the hearing date by 10:00 a.m. As the applicant has the burden of proof and as no evidence was adduced on its behalf, the Board has decided to dismiss the application.
Disposition
4The application is dismissed.
5The Director of Employment Standards Branch shall disburse the money held in trust in this matter as follows:
To Jasmin Dupuis $ 65.23
To the Government of Ontario
Consolidated Revenue Fund $100.00
Interest on the above amounts accrued
while held in trust shall be paid to the
recipients pro rata.
