DECISION OF THE BOARD; January 24, 2000
This is an employer request for review of Order to Pay No. 53644, which issued on September 16, 1999. The application is made pursuant to section 68 of the Employment Standards Act (the “Act”).
As noted in the Board’s earlier decision of December 17, 1999, on or about October 26, 1999 Merit Towing Corporation sent a payment stub to the Ministry of Labour indicating that it was seeking a hearing to appeal the Order to Pay. It also submitted a cheque in the amount of the Order and received a receipt from the Ministry on October 29, 1999. The last day for the filing of an application for review was October 31, 1999. It would therefore appear that although the application was not made on the appropriate form at the time, the applicant had indicated a timely desire to appeal the Order to Pay. In these circumstances this application will now be processed in the normal course.
