DECISION OF THE BOARD
1This is an application for certification that is scheduled to proceed to a hearing in Toronto on November 20 and 21, 2000.
2The Board has received correspondence dated November 10, 2000 from the responding party seeking to be relieved of its obligation to produce its witnesses at the hearing. The responding party wishes to simply bring one witness from Ottawa to Toronto for the two days of hearing.
3The labour relations community is aware that the Board’s current travel policy is that parties who are located more than a three hour drive from Toronto must have the first two days of hearings of their cases held in Toronto. Thereafter, the Board will try to accommodate requests to travel to a city in closer proximity to where the parties are located. Given the limited resources of the Board, it is not the Board’s intention that the first two days of hearing be wasted.
4The Board will not relieve the responding party of its obligation to produce witnesses for the hearing as it is the responding party that has the onus in this instance. It is up to the responding party to gauge for itself how long it will take with one witness. If it needs more than one witness in order to make full use of the two days of hearing, it is the responding party’s responsibility to ensure that sufficient witnesses are brought for that purpose.
