DECISION OF THE BOARD; September 13, 2000
1Further to the Board’s decisions dated July 14 and August 15, 2000, the parties have written to the Board concerning the claimant’s rate of pay, and are agreed that she earned $11.50 per hour. Accordingly, it is not in dispute that the employer is required to pay to her $920.00 in lieu of two week’s notice of termination.
2The applicant now seeks the payment of interest on this amount, together with compensation for time lost from work in order to attend meetings and hearings relating to her claim, and for the trouble of dealing with the application. I have no jurisdiction to award the latter amounts as there is no provision in the Employment Standards Act which creates such an entitlement. I do have the jurisdiction to award interest, but am not inclined to do so in the present case as the claimant did not seek interest at the hearing or in making her original claim, and the decision of July 14 should be considered final as to all issues other than the claimant’s hourly rate.
DISPOSITION
3Cartier Supply & Rentals Ltd. is hereby ordered to pay to the claimant Rose Marie Nidd the amount of $920.00 immediately upon receipt of this decision.
