DECISION OF THE BOARD; March 14, 2000
1This is an application seeking a review of an Order to Pay pursuant to section 68 of the Employment Standards Act, R.S.O. 1990, ch. E-14 (the "Act"). The application must be made 45 days after the date of the Order to Pay. That date was February 12, 2000. This application was not properly made until March 9, 2000.
2The Board has a discretion to extend the time for filing an application under section 68(4) of the Act. However, the applicant must provide the Board with some facts on which to consider exercising its discretion. The applicant is directed to provide the Board with the reasons it asserts are the basis for an extension of the time to file an application. At the same time, the applicant is requested to supply proof of payment of the amount required to the Director of Employment Standards, and some indication of when that payment was received by the Director. The applicant is directed to file this submission with the Board not later than 5:00 p.m. on the date ten days (excluding Saturdays, Sundays, and holidays on which the Board is not open) from the date of this decision.
