DECISION OF THE BOARD; July 26, 2000
1The Board is in receipt of correspondence from counsel for the Service Employees International Union, Local 663 (Local 663”) dated July 25, 2000 in which the Board is asked to issue an order directing production from the Sexual Assault Crisis Centre (Kingston) Inc. (“SACCK”).
2Upon reviewing the submission of counsel for Local 663 the Board directs SACCK to produce to Local 663 all documents in its possession, that SACCK is prepared to produce, relating to the negotiation and ratification of the Collective Agreement, and all documents that SACCK is prepared to produce received by the Board of Directors of SACCK in relation to their participation in the Application for Certification.
3The Board further directs that SACCK advise the Board and Local 663 no later than August 11, 2000 of those documents directed to be produced in paragraph 2 which is in its possession, but have not been produced, as to the reasons why they have not been produced.
4If there remains any dispute after August 11, 2000 regarding the documents sought to be produced and/or the scope of production the parties may bring such dispute to the attention of the Board with submissions as to their respective positions.
