DECISION OF THE BOARD; August 22, 2000
1This is an application pursuant to section 68 of the Employment Standards Act as amended by the Economic Development and Workplace Democracy Act, 1998, S.O. 1998, c.8. Minutes of Settlement have been executed by the remaining two persons who are the subject of this application. Accordingly, the Board orders as follows:
(i) that the wages paid to the "Director in trust" in relation to this matter be disbursed as follows:
to be paid to the Employer $6,414.89
to be paid to Frank Amodeo $ 194.26
(ii) that a portion of the
administration fee as set out in
the Order to Pay be retained by
the Government of Ontario
Consolidated Revenue Fund $ 660.91
total amount held by the Director $ 7,270.06
(iii) the application as it relates to Susan Villeneuve and Frank Amodeo is terminated in accordance with section 69.1(5) of the Act.
2The Ministry of Labour, a responding party to the application but not a signatory to the Minutes of Settlement, shall have ten working days from the date of this decision to request, if necessary, that this matter be relisted for hearing.
DISPOSITION
3In the absence of a request described in paragraph 2, this matter shall be deemed to be terminated. The hearing with respect to the application concerning Susan Villeneuve and Frank Amodeo, to be held on October 4, 2000, is hereby cancelled.
