DECISION OF THE BOARD
1This is an application pursuant to section 68 of the Employment Standards Act as amended by the Economic Development and Workplace Democracy Act, 1998, S.O. 1998, c.8. Minutes of Settlement have been executed by three of the five persons who are the subject of this application. Accordingly, the Board orders as follows:
(i) that the wages paid to the "Director in trust" in relation to this matter be disbursed as follows:
to be paid to Susan Beynon $ 33.50
to be paid to Kieth Cheshire 1,239.28
to be paid to John Potts 800.00
Total amount paid to employees $2,072.78
(ii) that a portion of the administration fee as set out in the Order to Pay be retained by the Government of Ontario Consolidated Revenue Fund $ 207.28
(the final figure will be determined when the last two applications are disposed of)
total remaining amount to be held by the Director in trust $7,270.06
2In view of the previous concerns expressed by the applicant and Ms. Suzan Beynon, Mr. John Potts and Mr. Kieth Cheshire, the Board directs that a copy of this decision be provided only to the applicants, their counsel, the Ministry of Labour and the persons who executed the Minutes of Settlement. In making this order, the Board expresses no view as to whether it is necessary to do so.
3The Ministry of Labour, a responding party to the application but not a signatory to the Minutes of Settlement, shall have ten working days from the date of this decision to request, if necessary, that this matter be relisted for hearing.
DISPOSITION
4In the absence of a request described in paragraph 2, this matter shall be deemed to be terminated with respect to these three responding parties. The file is referred to the Registrar for the listing of a hearing with respect to the application concerning Susan Villeneuve and Frank Amodeo.
