DECISION OF THE BOARD; February 17, 2000
1The only issue remaining outstanding in this application was a determination of the quantum of damages. Prior to the commencement of a hearing the parties entered into Minutes of Settlement resolving the matter.
2Having regard to the Minutes of Settlement dated February 17, 2000, the Board makes the following consent declaration and order:
The Board declares that the damages owing for the violation of the Principal Agreement are $2,000.00.
The Board orders the Responding Party to pay $2,000.00 in damages according to the following schedule:
(i) $1,000.00 by on or before March 31, 2000;
(ii) $1,000.00 by on or before April 30, 2000; and
orders that, should the Responding Party fail to pay the amount due on March 31, 2000, then the entire damages of $2,000.00 are due and payable to the Applicant and subject to immediate collection by the Applicant.
