DECISION OF THE BOARD; March 29, 2000
1This is an application under section 68 of the Employment Standards Act, R.S.O. 1990, c.E.14, as amended (the “Act”) to review Order to Pay No. 57856 issued on December 12, 1999.
2Meriana Verburg, the publisher and owner of the Port Colbourne Shopper wrote to the Registrar of the Board on February 21, 2000 requesting that the Board, in her own words: “…grant a delayed appeal in this matter without my having to advance the amount of the order to pay”. In its decision dated February 24, 2000, the Board (differently constituted) held that it does not have the authority to waive the requirement imposed by section 68(7) of the Act to pay the amount required by the Order to Pay to the Director of Employment Standards. The Board advised Ms. Verburg that unless she made an application for review in accordance with the Act, including the payment of the stipulated amount to the Director of Employment Standards, by no later than March 27, 2000, this matter would be terminated.
3The Board is advised that the applicant has complied with the Board’s decision dated February 24, 2000. Namely, the applicant filed an Application for Review (Form A-69) and paid the amount stipulated in the Order to Pay to the Director of Employment Standards by March 27, 2000. Accordingly, the Boards finds that this application is timely and directs the Registrar to process it accordingly.
