DECISION OF THE BOARD
1This is an application under section 96 of the Labour Relations Act, 1995 ("the Act") in which it is alleged that the responding party has violated section 74 of the Act.
2According to the certificate of delivery filed with the Board, this application was delivered to the responding party on June 26, 2000. However, the application was not filed with the Board until July 28, 2000.
3Rules 14 and 15 of the Board's Rules of Procedure provide as follows:
- Applications covered by Rule 100 (strikes and lock-outs) must be filed with the Board not later than one day after a copy of the application was delivered to the responding party.
Applications covered by Rule 65 (certification), Rule 70 (termination of bargaining rights under section 63 of the Act), and Rule 97 (interim orders) must be filed with the Board not later than two (2) days after a copy of the application was delivered to the responding party or parties.
All other applications must be filed with the Board not later than five (5) days after copies of the application were delivered to the responding party or parties.
- The Board will not process an application that fails to comply with Rule 14 and the matter will be terminated.
4It is clear that this application does not comply with Rule 14 of the Board's Rules. Accordingly, pursuant to Rule 15 of the Board's Rules, this matter is terminated.
5This decision is made without prejudice to the applicant's right to file another application which complies with the Board's Rules.
