This is an employer appeal filed under the Employment Standards Act, (the “Act”).
On the day scheduled for hearing of this matter, no one appeared on behalf of either the applicant or the responding employee. The representative from the Ministry of Labour was in attendance. The Board waited the usual one half hour after the scheduled starting time of the hearing and there was still no appearance.
In the Notice of Hearing dated July 24, 2000, paragraph 4 states:
If you do not attend the hearing, the Board may decide the application without further notice to you and without considering any document filed by you.
