1The following is a decision and order drafted by the parties and issued by me on consent and at their request:
This a review of the following Orders to Pay made under the ESA:
D01701 dated Dec 4, 1996 against Anthony Frank Ronza in the amount of $154,905.64
D01680 dated Dec 4 1996 against Anthony Walter Ronza in the total amount of $154,905.64
D01702 dated Dec. 4, 1996 against Stephen Sedlbauer in the total amount of $290,581.44
Anthony Frank Ronza, Anthony Walter Ronza and Stephen Sedlbauer were directors of the employer Susan Shoe Industries, a bankrupt.
Appearing before me were counsel for the 3 directors, representatives of the Ministry of Labour and their counsel and Mr. Reg Baughan on behalf of the union. No one else was in attendance.
The Ministry advises that compensation in excess of $300,000 under the Employee Wage Protection Program was paid to all but approximately 12 of the more than 350 claimants in respect of the entitlements covered by the orders. The Ministry is subrogated as regards the claimants who received WPP compensation.
Counsel for the Ministry and the 2 directors indicated that their respective clients are content that each of the orders be reduced to the sum $30,000.00 with the result that the three directors are jointly and severally responsible for the said sum of $30,000.00. It is so ordered.
The sum of $30,000.00 is to be paid to the Ministry within 6 months from the date hereof, failing which the Ministry can take enforcement measures.
Disposition
2Having regard to the foregoing, this matter is terminated.
