DECISION OF THE BOARD; August 15, 2000
Decision
The Board has received submissions from the parties pursuant to its decision of July 19, 2000. All parties request that further submissions be exchanged and that they meet with a Labour Relations Officer. The applicants also request that this matter proceed in much the same way as status examinations used to proceed with evidence being presented to an officer and transcribed and then argument presented to the Board. The Board does not consider it appropriate to proceed in the manner suggested by the applicants.
After considering the submissions of the parties the Board directs as follows:
Both parties are directed to exchange their submissions and any documents upon which they intend to rely on or before Friday, September 1, 2000. Copies of the materials should be provided to the Board.
Both parties are directed to file a reply to each other’s submissions on or before Friday, September 8, 2000. The replies should clearly set out any facts asserted by the other party with which the party filing the reply agrees or disagrees.
Labour Relations Specialist Ed Hunt will be in contact with the parties in the near future to set up a meeting to take place after Friday, September 8, 2000. Mr. Hunt will assist the parties in reaching agreement on facts and procedure including which application to proceed with first, whether viva voce evidence will be necessary, the use of representative witnesses etc.
The Board will retain the scheduled dates of October 17, 18 and 19 at this time. The parties can agree with Mr. Hunt’s assistance how those dates should be used or whether they should be adjourned or further dates added. However, if no agreement with respect to those dates has been reached by Tuesday, October 10 the parties are directed to file written submissions to the Board on that day as to how they wish to use the dates and the Board will decide.
