DECISION OF THE BOARD; May 23, 2000
1These matters are scheduled for hearing May 31, 2000 and June 1, 2000. Pursuant to sections 1(5) and 69(13) of the Labour Relations Act, 1995 (the “Act”) the applicant requested production of all documents relevant to the section 69/1(4) application by letter dated April 3, 2000 addressed to counsel for the responding party Seaway Glass and Aluminum Ltd. (“Seaway”).
2By letter dated May 18, 2000 the applicant requests the Board issue an order pursuant to section 111(1)(b) directing Seaway to disclose documents to the applicant in advance of the hearing.
3Having reviewed the materials in the file the Board directs the responding party Seaway to provide all relevant documents, as set out in the applicant’s letter to counsel for Seaway dated April 3, 2000, to the applicant and the Board by the end of the business day, Friday, May 26, 2000. If there is any issue with respect to disclosing any of the documents, the responding party Seaway is directed to identify the document or documents and give its reasons in writing to the applicant and the Board by Friday, May 26, 2000. Seaway is directed to bring any disputed documents to the hearing and the parties are to be prepared to make their submissions to the panel of the Board hearing these matters.
4The Board further directs the Labour Relations Officer assigned to these matters to contact the parties in order to assist them.
