DECISION OF THE BOARD; June 7, 2000
1This is an employer application filed pursuant to section 68 of the Employment Standards Act (the “Act”) requesting a review of the Order to Pay No. 51332 dated April 5, 2000.
2The deadline for filing this appeal was May 23, 2000. The application was received by the Board on May 24, 2000. By letter dated June 5, 2000 Counsel for the applicant requests an extension of time for filing this application. The applicant states it delivered the cheque to the Director of Employment Standards on May 23, 2000. The application was delivered to the Board after 5:00 p.m. on May 23, 2000.
3The Official Receipt No. 62859 issued by the Ministry of Labour shows the requisite payment was made in a timely manner on May 23, 2000. A copy of the cheque indicates it was certified by the bank on May 23, 2000.
4In the circumstances the Board considers it appropriate to exercise its discretion under section 68(4) and extend the time for applying for review to May 24, 2000.
