Having considered the submissions of the parties, and in the exercise of its discretion, the Board is of the view that the responding party must make its election as to whether or not it will call evidence in this proceeding before the Board proceeds any further in considering the responding party’s non-suit motion.
The Board directs the responding party to advise the Board and the applicant of its decision in this regard within 10 days of the date of this decision.
