DECISION OF THE BOARD; February 7, 2000
By letter dated December 13, 1999 the applicant requests reconsideration of the Board’s decision of November 10, 1999.
The basis for the reconsideration appears to be a concern that the Board did not consider certain allegations set out in the application concerning the applicants’ participation in an arbitration, and the position taken by the responding party trade union during that arbitration.
During the course of the consultation on October 14, 1999, the Board spent considerable time on various aspects of - and the parties’ positions regarding - the arbitration. The applicants’ allegations as set out in their application were certainly considered by the Board in the context of this review during the consultation. Ultimately, after testing the applicants’ case on this point, the Board concluded that there was little or no basis offered by the applicants during the consultation for their allegations concerning the arbitration.
The Board will not reconsider a decision in circumstances where the applicant is merely re-arguing the case it presented at first instance.
The request for reconsideration is dismissed.
