DECISION OF THE BOARD
1This is an application for review of a decision of an Employment Standards Officer pursuant to section 68 of the Employment Standards Act, RSO 1990, ch. E-14. The application was filed on May 31, 2000, two days after the time for filing the application had expired.
2The applicant states that he did, in fact, file his application, but did so by delivering it to the Employment Standards Officer. His office is in Newmarket. The application itself clearly indicates the application is to be delivered to the Board at 505 University Avenue, Toronto.
3The Board has a discretion under section 68(14) to extend the time for filing an application. While the applicant should have read the application more clearly, he did attempt to comply with the statute and did deliver the payment of monies in trust as required prior to the expiry of the time for filing an application. There is no prejudice to any other party. Accordingly, the Board hereby extends the time for filing this application to May 31, 2000, the day on which it was received by the Board.
4The application is referred to the Manager of Field Services for processing.
