v.
Jillian Allingham, and Ministry of Labour, Responding Parties.
Before: David A. McKee, Vice-Chair.
DECISION OF THE BOARD
1This is an application for a review of a decision of an Employment Standards Officer pursuant to section 68 of the *Employment Standards Act*, R.S.O. 1990 ch. E-14 ("the Act"). The application was made on June 20, 2000, the date on which it was received by the Board. Although it was sent by courier, the Board only accepts the date of delivery to a courier as the date of filing in applications for certification or termination of bargaining rights.
2Strictly speaking, the application was filed one day after the time for making an application had expired. However, section 68(4) gives the Board the authority to extend the time for filing an application. In this case the time is trivial, the monies which were required to be paid to the Minister in trust were paid in time, and there is no prejudice to the responding parties. Accordingly, the Board extends the time for filing the application to June 20, 2000.
3This matter is referred to the Manager of Field services for processing. I am not seized of this application.
