DECISION OF THE BOARD; August 4, 2000
1This is an employee request for review of an Employment Standards Officer’s decision not to issue an order in favour of the applicant. It is made pursuant to section 68 of the Employment Standards Act (the “Act”).
2By a decision dated July 21, 2000, another panel of the Board requested submissions with respect to the applicant’s request for an extension of the time to file his appeal. To date the Board has only received the Ministry of Labour’s submission, and it indicates no objection to the granting of an extension. The employer filed no submission.
DISPOSITION
3There appears to have been some misunderstanding in the communications between the applicant and the Officer leading to the slight delay in filing the application. In any event, the application is only nine days out of time. In the circumstances the Board exercises its discretion pursuant to section 68(4) of the Act to extend the time for filing this application to May 4, 2000.
