DECISION OF THE BOARD; August 14, 2000
1Counsel for the Ministry of Labour has requested that these two matters be heard together as they relate to the same employer. The issues in dispute in these two files are quite distinct. Board File No. 3874-99-ES raises an issue as to whether an individual who resigns prior to the end of a fiscal year is entitled to a prorated bonus payment. Board File No. 3791-99-ES raises an issue as to whether an individual is excluded from the severance pay provisions of the Employment Standards Act by virtue of section 58(6)(e). There is no basis for hearing these two matters together and accordingly the request is denied.
