DECISION OF THE BOARD; September 11, 2000
1The responding party, Local 210 Staff Association (“the Association”) raises a preliminary objection challenging the applicant’s standing to bring this application. It asks the Board to dismiss the application without a hearing on the basis that, in the Association’s view, the applicant is not a party to what the Association claims is a collective agreement between it and the other responding party in this matter, and therefore cannot challenge its validity.
2This application raises novel issues. The Board is not prepared at this point to determine the issue of standing, and declines to dismiss the application on a prima facie basis.
3The Association may renew its motion before the panel of the Board assigned to hear this matter.
