DECISION OF THE BOARD; April 7, 2000
1. This is an application for certification.
2. By decision dated March 24, 2000, a vote was ordered to be held on March 28, 2000. In that decision it was noted that no decision had been issued in Board File No. 3674-99-R, which decision might impact upon this application. A decision in that matter has now been made dated April 7, 2000. The ballot box was sealed pending a resolution in that file.
3. Though the employer gave notice under section 8.1 of the Act that it disagreed with the union’s estimate of the number of individuals in the bargaining unit included in the application for certificates, the employer agreed that the ballots in the representation vote be counted.
4. As there has been a decision rendered in File No. 3674-99-R and having considered such decision, the Board directs that the ballots in this matter be counted.
5. The matter is referred to the Registrar to arrange for the counting of the ballots in this matter.
