1The applicant filed a reply to the issues raised by the responding party as outlined by the Board in its decision dated March 1, 2000.
2The responding party also filed further submissions with the Board by letter dated March 10, 2000.
3There is an issue in this application as to whether the applicant informed the responding party about his desire to file a grievance under the collective agreement within the time permitted for filing grievances. The applicant states that he did. The responding party states that he did not. The Board cannot decide this issue, which appears to be a material one, purely on the basis of the written submissions. At this juncture, the Board is not prepared to dismiss the application for failure to disclose a prima facie case.
