DECISION OF THE BOARD; April 3, 2000
This is an application for review of a decision by an Employment Standards Officer which found that the applicant is liable as a director of a company under the Employment Standards Act (the “Act”).
The deadline for filing the appeal was December 4, 1999. Payment with respect to Order to Pay No. D05821 was received by Employment Standards on December 23, 1999. The applicant has requested an extension to file this application for the reasons set out in the documents filed with the Board.
I am satisfied that the applicant did not receive the documents from the Ministry of Labour in time to make a timely application for review. In the circumstances and in the exercise of the Board’s discretion pursuant to section 68(4) of the Act, I am prepared to extend the deadline for the filing of this application to December 29, 1999.
