DECISION OF THE BOARD; October 20, 2000
This is an application for relief pursuant to section 100 of the Labour Relations Act, 1995 in relation to an alleged unlawful strike by the responding parties.
Prior to the commencement of the hearing, the parties were able to resolve all outstanding matters.
Further to the agreement of the parties, the Board hereby:
declares that the Responding Parties have violated sections 79(1), (2), 81 and 83(1) of the Labour Relations Act, 1995, as applicable, in regards to the refusal of certain employees to work overtime on the weekend of Friday, October 13th, 2000;
directs that the Responding Parties cease and desist from violating the above referenced sections of the Act;
directs that anyone having notice of this decision cease and desist from: engaging in an unlawful strike, authorizing, threatening to call, encouraging, counseling or procuring an unlawful strike; or doing any act, the probable and reasonable consequence of which is that another person or persons will engage in an unlawful strike at or in relation to 72 Sterling Road.
